Abstract

Jammu and Kashmir, a region nestled in the northern part of the Indian subcontinent, has been a long-standing source of political and territorial dispute between India, Pakistan, and China. This comprehensive analysis delves into the intricate web of historical, geopolitical, and legal aspects surrounding the Jammu and Kashmir issue. It explores how diplomacy has been employed as a tool to address the dispute and how the matter has evolved into “lawfare,” where international legal claims and arguments play a central role. This paper examines the various legal perspectives and claims put forth by the involved parties, including India, Pakistan, and the people of Jammu and Kashmir, and assesses the impact of these claims on the ongoing conflict.
