Arthashastra Underpinning: A Case Study of Article 370

The Kashmir conflict is a globally recognized territorial dispute between Pakistan and India since its inception. The bilateral issue has been further exacerbated over time by various unilateral moves adopted by India to legalize its occupation of IIOJK (Indian Illegally Occupied Jammu and Kashmir). With the intensification of Hindutva-driven policy frameworks, primarily influenced by Chanakya’s philosophy, India is on the verge of unilaterally dissolving the lingering conflict. The Modi regime has taken various illegal actions, such as revoking Article 370, establishing Sainik colonies, resettling Kashmiri Pandits, and providing impunity for occupational forces, all in an effort to legitimize its occupation of IIOJK. Kautilya’s Arthashastra advocates that land acquisition should be pursued as a superior goal, even at the expense of other moral considerations.
